Constituição e Poder Constituinte na Revolução Inglesa e na Revolução Norte-Americana: itinerário, legado e contradições

Este artigo busca resgatar o debate sobre os conceitos de Constituição e poder constituinte no contexto da Revolução Inglesa, no
século XVII, e da Revolução Norte-Americana, na segunda metade do século XVIII. Inicialmente, explicam-se as transformações por que passou o direito na alvorada da Modernidade: um novo vocabulário, uma nova gramática, uma nova forma de enxergar o mundo. Em seguida, recupera-se a construção da ideia de supremacia do Parlamento no direito inglês. Por fim, aborda-se o itinerário da independência das colônias inglesas na América do Norte, com enfoque na discussão sobre a Constituição, propondo-se uma releitura crítica do legado “revolucionário”.
