Digital anonymity and fake news
limits to freedom of expression in the protection of fundamental rights

This article analyzes the constitutional limits of freedom of expression in light of the phenomenon of fake news disseminated under anonymity on social media. It argues that digital anonymity, although technically facilitated, conflicts with the Brazilian legal framework by preventing the accountability of content that harms fundamental rights. The study is based on the premise that freedom of expression, while essential to democracy, is not an absolute right and must be reconciled with the duties of good faith and the protection of honor, image, and truthful information. It is demonstrated that the digital environment, by encouraging the creation of anonymous profiles and the circulation of unverified content, weakens the social function of journalism and broadens the regulatory disparity between professional agents and ordinary users. The article concludes that the current regulatory framework must be revised, with emphasis on limiting online anonymity and recognizing the civil liability of digital platforms.
